Describing a Design- When Enough is Enough!

Perry Saidman & Kerry Leonard have co-authored an article entitled “Describing a Design- When Enough is Enough!” that is online in Edison, an open access journal published by the Journal of the Patent & Trademark Office Society (JPTOS). The article explores the “written description” requirement under 35 U.S.C. 112 with respect to both utility and design patents. The issue of what constitutes a proper written description necessary to support an amended or continuation claim is one of today’s major challenges faced by design patent applicants and practitioners.
